Trust Deed

Also known as a Declaration of Trust, Settlement Deed or Trust Instrument.

The document that creates a trust and lays down the foundations of how the trustees are to manage and administer the trust assets and how they are to distribute and dispose of trust assets during the lifetime of the trust. A trust may be created in certain jurisdictions by a trustee or a trust company without the settlor either being identified or being a signatory to the declaration.
